Terms of Service

These Terms of Service ("Terms") govern your use of The Stream Facility ("Platform," "Service"), operated by Stream Facility ("we," "us," "our"). By creating an account or using the Platform you agree to these Terms.

1. Eligibility

You must be at least 13 years of age to create an account and use the Platform. Users aged 13 to 17 may register and access General, Teen, and Mature-rated content. Explicit-rated content is restricted to users aged 18 and over; the Platform enforces this restriction through date-of-birth verification. If you are under 13, you may not create an account or use the Platform under any circumstances. By registering, you confirm that you meet the applicable age requirement. If we become aware that an account holder is under 13, we will immediately terminate that account and delete the associated personal data.

2. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at https://streamfacility.com/contact if you suspect unauthorized access.

3. Subscriptions and Payment

The Platform offers tiered subscription plans providing access to writing and publishing tools. Subscriptions renew automatically on a monthly or annual basis as selected at the time of purchase. Payments are processed securely by Stripe. By subscribing you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time through Dashboard → Profile → Plan & Subscription → Manage billing. Cancellation takes effect at the end of the current billing period; you retain full access until then.

4. Desktop Application

Pro subscribers may access the Stream Facility Desktop application. The desktop app operates under a perpetual fallback license: if your Pro subscription lapses, you retain the right to use the last version of the desktop app you downloaded during your active subscription, subject to these Terms. Account termination for violation of these Terms voids the perpetual fallback license.

5. Your Content

You retain full ownership of all written works, characters, worlds, outlines, notes, and other creative content ("Your Content") that you create on the Platform. We claim no ownership rights over Your Content.

You grant us a limited, non-exclusive, royalty-free license to store, process, display, and sync Your Content solely to provide the services described herein. This license ends when you delete the content or close your account.

AI-generated text: If you use the Platform's AI writing assistance and incorporate AI-generated text into your work, you are responsible for determining the copyright status of that output under the laws of your jurisdiction. We make no warranty that AI-generated text is original or non-infringing.

6. Shared and Published Content

If you choose to publish works publicly or share them with beta readers, you grant those users a personal, non-commercial license to view and comment on your shared content. You may revoke sharing access at any time. Making a work public does not transfer any intellectual property rights.

7. AI Writing Assistance

The Platform includes optional AI writing assistance powered by third-party AI providers. AI-generated text is provided as a creative tool only. You are solely responsible for reviewing and deciding whether to incorporate any AI suggestions into your work. AI feature usage is also subject to the terms of the applicable third-party AI provider.

8. Prohibited Uses

You agree not to:
- Upload, post, or transmit content that is illegal, defamatory, obscene, or that infringes any third-party intellectual property right
- Use another person's account or impersonate any person or entity
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Use automated tools to scrape or extract content from the Platform
- Interfere with or disrupt the Platform's infrastructure or servers
- Share your account credentials with any third party
- Submit false or bad-faith copyright takedown notices

9. Intellectual Property

The Platform, including its software, design, trademarks, and editorial content (excluding Your Content), is owned by us or our licensors and is protected by copyright and other intellectual property laws.

10. Indemnification

You agree to indemnify, defend, and hold harmless Stream Facility and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) Your Content; (c) your violation of these Terms; or (d) your infringement of any third-party right. This obligation survives termination of these Terms.

11. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party site. Links do not constitute endorsement.

12. Termination

We may suspend or terminate your account for material violation of these Terms, with or without notice. You may close your account at any time from your profile settings. Upon termination, we will delete Your Content in accordance with our Privacy Policy. Subscription fees already paid are non-refundable except as described in our Refund Policy.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Nothing in this section limits liability that cannot be excluded under applicable law, including for death or personal injury caused by our negligence, fraudulent misrepresentation, or any statutory consumer rights that cannot be waived.

15. Force Majeure

We are not liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, internet or infrastructure outages, pandemics, or government actions.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

United States users: Any disputes that cannot be resolved informally will be submitted to binding individual arbitration under the rules of the American Arbitration Association. You waive any right to bring or participate in a class action. Either party may seek emergency injunctive relief in court.

European Union / EEA users: Mandatory consumer protections under applicable EU law apply and are not waived. Arbitration clauses are not enforceable against EU consumers where prohibited by local law. EU consumers may also refer disputes to their national consumer protection authority or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

United Kingdom users: UK consumer rights under the Consumer Rights Act 2015 and other applicable UK law apply and are not waived by these Terms.

Australian users: Australian Consumer Law guarantees apply and are not excluded by these Terms.

Canadian users: Provincial consumer protection laws apply where applicable.

17. Changes to These Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes by email or in-app notice. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may close your account before the effective date.
